IPhone 3G finally arrived and it’s broken…

So I decided to avoid the lines and order my IPhone 3G through AT&T’s direct fullfillment plan.  It took a full two weeks to arrive.  They converted my plan from my old IPhone to my new one quickly enough.  Once I got the phone home I found the sound had a ticking to it through both the speakers or earphones.  A restore didn’t help.  I called AT&T and was told that we can’t help you because we don’t have any more phones and if we did have another phone we would exchange it but would have to charge you a 10% re-stocking fee even though you brought it back the same day as a broken phone.  Can you believe that!  So I called Apple and was told that I could mail the phone in to them for warranty or I could drive 60 miles to the nearest Apple store and hope they have one in stock.  So I decided to call the store and make an appointment.  I was told that they could do that but I should take the phone back to AT&T since they sold it as broken?  Apple incicated that they would of course switch the phone out under warranty but couldn’t gaurantee they would have one any time soon.  So!  I have a broken 3G piece of crap and nobody wants to take any responsibility for it.. Of course, AT&T didn’t hesitate to up my rates since I’m on the new 3G phone!
